1. Acceptance of Terms

By accessing or using Wraply's services, you agree to be bound by these Terms of Service. If you disagree with any part of these terms, you may not use our services.

2. Description of Service

Wraply provides link shortening, management, and analytics services. Our platform allows users to create and track shortened URLs.

3. User Responsibilities

As a user of Wraply, you are responsible for:

  • Maintaining the security of your account credentials
  • All activities that occur under your account
  • Ensuring your use of the service complies with all applicable laws
  • The content and destination of all links you create
  • Any consequences resulting from the use or misuse of your links by any party

4. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING OUT OF COURSE OF DEALING OR USAGE OF TRADE.

Wraply does not warrant that:

  • The service will be uninterrupted, timely, secure, or error-free
  • The results obtained from using the service will be accurate or reliable
  • Any errors in the service will be corrected

5. Content Responsibility and Liability

YOU ARE SOLELY AND ENTIRELY RESPONSIBLE FOR:

  • The destination URLs of all links you create
  • All content accessible through your shortened links
  • Any products, services, or information offered through your links
  • How your links are distributed, shared, or used by any third party

WRAPLY EXPRESSLY DISCLAIMS ALL RESPONSIBILITY AND LIABILITY FOR:

  • The content of any websites or resources linked through our service
  • Any malware, viruses, phishing attempts, or malicious software encountered via links created using our service
  • Any damages, losses, injuries, or harm of any kind resulting from accessing or using links created through our service
  • Any illegal, harmful, or unauthorized use of links created through our service
  • Third-party actions taken based on or through your shortened links

Wraply has no obligation to monitor the destination or use of shortened links and assumes no responsibility for doing so.

6. Indemnification

You agree to indemnify, defend, and hold harmless Wraply and its officers, directors, employees, agents, licensors, and suppliers from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from or relating to:

  • Your use of the service
  • Your violation of these Terms
  • Your violation of any rights of a third party
  • Any content accessible through links you create
  • Any claims made by third parties related to your links

7. Prohibited Uses

You may not use Wraply for any illegal or unauthorized purpose, including but not limited to:

  • Distributing malware, viruses, or malicious software
  • Phishing or fraudulently obtaining sensitive information
  • Spamming or sending unsolicited communications
  • Infringing intellectual property rights
  • Promoting illegal activities or violence
  • Harassing, threatening, or defaming others
  • Distributing illegal or harmful content

8. Link Removal and Account Termination

Wraply reserves the right to:

  • Disable or remove any shortened link at any time without notice
  • Terminate or suspend your account immediately, without prior notice or liability, for any reason
  • Modify or discontinue the service at any time without notice

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL WRAPLY, ITS DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your access to or use of (or inability to access or use) the service
  • Any conduct or content of any third party on the service
  • Any content obtained from the service
  • Unauthorized access, use, or alteration of your transmissions or content

Our total liability for any claims under these terms shall not exceed the amount you paid us to use the service in the past twelve months.

10. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with applicable laws. Any disputes arising from these Terms or your use of the service shall be resolved through binding arbitration, except where prohibited by law. You agree to waive any right to participate in class action lawsuits against Wraply.

11. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated with at least 30 days' notice. Continued use of the service after changes constitutes acceptance of the new terms.

12. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
